Karen Mertes always jumps at the chance to inspire groups with her story. She recently spoke at South University in Tampa to the graduating class. Here is a snippet from the letter that Campus President James McCoy sent her —

karen Mertes AuthorIn 2007, Karen’s car was struck by a drunk driver traveling over 100 mph on I-75 resulting in Karen suffering a Traumatic Brain Injury (TBI).  Facing the consequences of this life-changing injury, this would be the genesis which led her to create Fulfill Your Destiny.  Its signature program awards ‘Business Builder Grants’ to local entrepreneurs desiring to take their businesses to the next level.

Is My Career Over Because of my TBI?

After suffering an injury from a car accident, however mild or severe it may be, you must learn how to live life with your injury. It is important to remember that no matter how frustrated you become, some of these effects will only be temporary. Although, you may need to learn a ‘new normal.’

Initially, you may experience a period of denial where you’re unable to realistically assess what could be your reduced performance levels. Given my injury, I was no longer able to achieve my pre-injury performance where I had consistently exceeded expectations.

Unfortunately, depending on the severity of how your injury may impact your work performance, it could pose a threat to your case. The defense will use whatever new challenges you face at work as a litigation advantage.

You may be placed in a “no-win” situation. If you cannot return to work, his [the defense attorney] bargaining position has improved due to your lack of limited resources to live on. Also, his experts will likely opine you are a malingerer. If you do return to work, even under duress and in pain, he will argue you did not suffer economic damages as you continued to be “employable” post-injury.”

How to Enjoy Cinco De Mayo Without a DUI

According to the National Highway Traffic Safety Administration (NHTSA), around 38 percent of traffic fatalities that have occured each year on or around May 5 are alcohol related.

Screen Shot 2017-05-02 at 6.21.11 PMIf you do need to drive – Enjoy drinks slowly and alternate with glasses of water. Stop drinking a few hours before driving, and make sure to eat food to soak up the alcohol in your stomach.

Ride sharing apps are all too common to still be driving home drunk. If you can’t afford a sober ride home, then throw a party at your own place or stay with a friend. Taking the risk of driving drunk isn’t worth your life or another’s.

Be mindful of other drivers. If you are the designated driver for the night, make sure that you are watching out for other drivers on the road. You never know if someone has decided to drive after having one too many and their vision and judgement is impaired.

Tips on How To Be a Top Law Student

Thinking about going to law school or already a law student? Here are some tips that we’ve selected from a list thanks to Fowler School of Law

  1. DO THE READING. Do all of the reading assigned for your courses. Do not fall behind; you may never catch up. Do your reading at times of the day when you are most alert. Also, do your reading in a location where you will not be distracted or tempted to do something else. Otherwise, you will find that it takes you far longer than necessary to prepare for class.
  2. BRIEF THE CASES. Take notes while reading. For each assigned case, write down the legally significant facts, the holding of the case, and the rationale for the court’s decision. This is what is referred to as “briefing” cases. Your case briefs should be just that-brief.
  3. REVIEW BEFORE EACH CLASS. Review your reading notes (case briefs) right before class. That way, the cases will be fresh in your mind, and you will substantially increase your ability to follow the class discussion (not to mention avoid the embarrassment associated with being unprepared when called upon by the professor).
  4. GO TO CLASS. Most professors cover some material in class that is not discussed in the reading, so failure to attend class will put you at a big disadvantage when you take the final exam.
  5. PAY ATTENTION IN CLASS. Some misguided students use class time to shop on the Internet, play computer games or catch up on their e-mail. You are paying a substantial amount of money for tuition. Do you really want to spend your tuition money “surfing the net” or playing computer solitaire instead of paying attention to the class discussion?
  6. PARTICIPATE IN CLASS. Students learn best when they are actively engaged in the learning process.
