Need a Stocking Stuffer for your Law Student? Look no further than “Plaintiff 101”

Karen Mertesa Drunk Driving Victim herself and creator of “PLAINTIFF 101” shares her story with us of an unfortunate circumstance. She takes an in-depth look inside the courtroom at the coverage of the legal and technical issues that arise in a drunk driving case. Karen wrote “Plaintiff 101” to serve as a guide to assist both client and lawyer through civil litigation during a personal injury lawsuit.

plaintiff-101-cover-audioLitigation is a team effort between plaintiff and lawyer and it’s not the place for trial and error. “Plaintiff 101” will help the client understand the process, relieve some of the fear and anxiety clients may have, and facilitate effective communication between client and lawyer.

PLAINTIFF 101 is dedicated to anyone who has been or will be a plaintiff in a personal injury lawsuit, to the attorneys who represent those who have been injured due to the negligence of others, and to the American Association for Justice who continues to wage the fight to keep our courthouse open to all citizens.

See what people are saying about Plaintiff 101!

Very useful for ANYONE. You never know what could happen at any moment and always important to be prepared.”

How to Win Your Personal Injury Litigation

plaintiff-101-cover-audioWhen going through a personal injury litigation, it is hard to know who is to trust. But once you have your lawyer on retainer, it is extremely beneficial to be completely open with your attorney. Below is Takeaway #8 from the Amazon Best Seller, “Plaintiff 101″—

Takeaway #8

Do not keep any secrets from your lawyer. If something in your past may hurt your case, tell your lawyer first. In all probability, it’s not as bad as you think. Remember the lessons of history. It wasn’t the break-in that led to Richard Nixon’s downfall. It was the cover-up.

A lawsuit is a team effort between you and your law firm. To achieve a successful result, you must meet your responsibilities with your best efforts. Be open, honest and flexible throughout your case.

Thinking about going to law school or already a law student? Here are some tips that we’ve selected from a list thanks to Fowler School of Law

  1. DO THE READING. Do all of the reading assigned for your courses. Do not fall behind; you may never catch up. Do your reading at times of the day when you are most alert. Also, do your reading in a location where you will not be distracted or tempted to do something else. Otherwise, you will find that it takes you far longer than necessary to prepare for class.
  2. BRIEF THE CASES. Take notes while reading. For each assigned case, write down the legally significant facts, the holding of the case, and the rationale for the court’s decision. This is what is referred to as “briefing” cases. Your case briefs should be just that-brief.
  3. REVIEW BEFORE EACH CLASS. Review your reading notes (case briefs) right before class. That way, the cases will be fresh in your mind, and you will substantially increase your ability to follow the class discussion (not to mention avoid the embarrassment associated with being unprepared when called upon by the professor).
  4. GO TO CLASS. Most professors cover some material in class that is not discussed in the reading, so failure to attend class will put you at a big disadvantage when you take the final exam.
  5. PAY ATTENTION IN CLASS. Some misguided students use class time to shop on the Internet, play computer games or catch up on their e-mail. You are paying a substantial amount of money for tuition. Do you really want to spend your tuition money “surfing the net” or playing computer solitaire instead of paying attention to the class discussion?
  6. PARTICIPATE IN CLASS. Students learn best when they are actively engaged in the learning process.

You can find the entire list here.

Book Karen to Speak at Your Fall Commencement!

Now that school is in session it is very important to communicate to incoming freshmen and even returning students the dangers of driving even after one drink.

Hit by a Drunk Driver at over 100 mph and Alive to Tell

Karen Mertes, a Lieutenant Colonel in our United States Air Force, was driving the speed limit on the interstate when she was struck by a drunk driver traveling over 100 mph.  He had a blood-alcohol level of nearly three times the legal limit.  Both vehicles were totaled.  Her axle snapped in half, with brakes and steering inoperative.  Karen made a futile attempt to regain control of her vehicle as her car slid sideways down the interstate. Other cars still remaining in the bordering lanes traveling by her at highway speeds.  During these split seconds, as her life hung in the balance, Karen made a bargain and promised that if she were fortunate to survive, she would spend the rest of her life helping others.  This was the genesis for what has become Fulfill Your Destiny, Inc. www.fulfillyourdestiny.org
